SENTENCE OF WESTON J
- Mr Tereapii, you are here today to be sentenced for drunken driving causing injury and breach of s. 25 of the Transport Act. This
is your first appearance.
- The Probation report speaks of your good work record and it also speaks of the remorse for causing the problem.
- It seems that the main cause of that problem is alcohol. Alcohol and driving is a problem this Court frequently encounters and is
one that is of considerable concern to the Court. The Probation Service has recommended that you receive 3 months community service
plus 12 months probation on certain terms.
- Having considered all the materials and what I have heard this morning, I believe that the sentence recommended by the Probation
Service is an appropriate one. So, you are sentenced to 3 months community service with 12 months probation, starting now, upon the
terms set out in the Probation report. There are three of them which I briefly summarize, you are to abstain from consuming or purchasing
alcohol, you are not to enter any licensed premises and you are to go to any training program if the Probation Service so directs
you. You are disqualified from holding a drivers license for two years and ordered to pay reparation in the amount of $518.35 plus
$275 to Charlene Hoff and $532 to Ngarangi Thompson.
