Police v Iotua [2006] CKHC 32; CR86,87,88,89,90.06 (27 October 2006)
IN THE HIGH COURT OF THE COOK ISLANDS
HELD AT RAROTONGA
(CRIMINAL DIVISION)
CR NO: 86. 87, 88, 89, 90/06
POLICE
v
RIMA IOTUA
Defendant
Date of Sentence: | 27 October 2006 |
Counsel: | Sgt Howard for Police |
Mr Rima Iotua | in person |
SENTENCE OF WESTON J
- Mr Iotua, I am now going to sentence you.
- You have pleaded guilty to 5 charges, the maximum punishment for any one of those is 10 years. You have a history of previous offending
of a similar kind. It seems to me you have a strong and supportive family but you choose to turn your back on that. Your actions
embarrass your mother and you stepfather, but you do not care about that.
- You have admitted that you were the ring-leader for these offences. Burglaries of these sort cause a lot of misery to the people
that you steal from. They have done nothing to hurt you but you hurt them. Like Mr Tamatoa, I think it is time that you finally grew
up.
- I sentence you to 6 months community service and 18 months probation starting from now with some conditions which I will mention
in a minute.
- The first condition is that you are not to be outside your house at night between the hours of 7.30pm and 6.00am. The second condition
is that you are not to associate with Exham George of Avatiu. There is a third condition which is that you are not to purchase or
consume any alcoholic liquor.
