DECISION OF SMITH J


Consequent upon the completion of the hearing yesterday of the matters arising over complaints in respect to work carried out at the Avarua CICC cemetery, and to ensure that if settlement can be effected, there will be no delay in implementing such, and to prevent the necessity of forwarding the files to New Zealand for consideration by the Judge. There is now an order terminating the Interim Injunction Order currently in place in these proceedings, SUBJECT TO AND CONDITIONALLY UPON the said Church and the Cultural and Historical Places Trust, filing with the Registrar a joint memorandum confirming that they have agreed to work together towards finding and achieving settlement of the beautification of the cemetery.
