High Court of the Cook Islands |
IN THE HIGH COURT OF THE COOK ISLANDS
HELD AT RAROTONGA
(CRIMINAL DIVISION)
CR NO. 474/02, 485/02
POLICE
v
WILLIE JEREMIAH TUAINE
Defendant
Mr Titaa for Police
Mr George for Defendant
Date of Sentence: 4 July 2003
DECISION OF SMITH J
You've heard what Mr George has said in your favour, you would have seen the Probation Report and the fact that the Probation Officers feel that you should be given another chance. This is your first appearance before this Court, we hope it will be the last. I accept the Probation Officer's report, you are being placed on probation for a period of 18 months. During the first 6 months you will be doing community service and you will be required to abstain from the consumption or purchase of liquor, you shall not enter licensed premises and you must attend any training workshop programs which the Probation Service direct you to. There's a further charge of contempt insofar as the accused failed to report to the police. That information is dismissed. So we are told by the Probation Service in effect that your failure to report to the police as directed during your bail was a one-off offence, you are now required to comply with the terms of the Probation Office ruling otherwise you may come back to s on that and you may not get off so lightly.
