DECISION OF SMITH J
I am abiding by the report from the Probation Officer and you are to appear before this Court if called upon within 6 months time. So if you keep a clean record the matter will go away. Under the Transport Act it states that "upon conviction of an offence of this nature, the Court will disqualify you from obtaining or holding a license. You are disqualified from holding or obtaining a license for a period of 1 month and the period of disqualification is to begin on the 8th of February 2003, I'm backdating it because you've been off the bike for the last 6 months anyway. So I've got to impose it, I'm imposing it "on conviction" within the letter of the law of the Act, I hope that nobody has seen you driving because if you have, you've been driving while disqualified. Alright, you know what I've done, I've disqualified you but the time is gone, you've outlived it so that there's no disqualification in place at this time but if you abide by the law for the next 6 months you have no more trouble.
