High Court of the Cook Islands |
IN THE HIGH COURT OF THE COOK ISLANDS
HELD AT RAROTONGA
(CRIMINAL DIVISION)
CR NOS. 225/03, 226/03
POLICE
v
TAPUTU MANUELA
Defendant
Inspector Patia for Police
Mr Rassmussen for Defendant
Date: 21 November 2003
SENTENCE OF WILLIAMS J
Ms Manuela you appear today because you have stolen money out of your cousin's bank account which was a very bad thing to do. It's bad at any time to be stealing, it's even worse when you are robbing a member of your family. I understand that you didn't just waste the money, you spent it on baby clothes but it wasn't your money to spend and it's very disappointing that you would have done such a thing. The probation report tells me that you are remorseful and sorry for what you've done and you have to your credit tried to pay back some of the money, you have paid $250.00 altogether. I can't suppress your name because it would be unfair to other defendants and the public is entitled to know what has happened, I sincerely hope you will never do this again. You have a supportive partner and there is no reason why you can't live a good and happy and productive life. So I hope you will never come here again and the order will be that you are sentenced to 12 months on probation supervision, 3 months of that to be served on community service. I should also order the restitution of $300.00 which is the amount owing to make up the $550.00, so there will be the restitution order and when you can you will pay that back to square the debt and pay your cousin, thank you very much.
JUDGE
