IN THE HIGH COURT OF THE COOK ISLANDS
HELD AT RAROTONGA
(CRIMINAL DIVISION)

CR NO. 126/99, 127/99

POLICE

v

K

Mr Elikana for Crown
Mr George for Defendant

Date: 1 June 1999

DECISION OF QUILLIAM CJ

Although you have said that your wife told you that you are not the father of the girl I have no doubt that you know perfectly well that she was. You took advantage of your daughter and there is very little that can be said in your favour. I give you such credit as I can for your plea of guilty. But I am concerned as to whether you truly are remorseful to what you did. You had previously committed an indecent assault on the same daughter. You were then sentenced to 2 years imprisonment but that was not enough to warn you of what would happen if you offended again. For the protection of the daughter, I am prepared to suppress your name. On each charge you are sentenced to imprisonment for a term of 5 years, the terms to be concurrent.
